And again following on from the NHA and Petergate, what happens if the judge/s throws out both parties cases ? Is their a chance that both parties might be completely innocent or both as guilty as hell ?
We might possibly only know in 2 years time. For now and tomorrow, is that acceptable dear stakeholders and punters

Whipgate – Lerena & Gates Sanctioned
Gavin Lerena went to work as he always does on the fateful day, he had one intention in mind and that was to do his best, as he always does, a quick glance at his stats show how good his best is, high above the considered good 20 percent of rides to win and much much higher of "in the money rides", he rode a fancied supported runner that Gates has no right to interfere with, during the running Gavin moved up on the outside of Jason Gates, Gates then keeps him outside and carries him to the worst going, Gavin in wanting to do his best tries to move to the inside, something Jason should have also wanted to do, yet Jason refuses to budge and keeps Gavin and himself out of the better going which alone raises questions of Jason's thinking,
Jason is on a 66/1 outsider, form studiers, odds makers and handicappers understand the meaning of form and Jason Gates mount had run 9 times up to then and was beaten more than 125l collectively, Gavin's mount had run 3 times placing in all three and has since won,
When Gavin gets close to Jason, Jason deliberately and knowingly whips Gavin and Gavin's mount, anyone who thinks Jason did not know Gavin was there and that he closed his eyes and whipped wildly around hitting Gavin by mistake knows nothing about riding a horse, Gavin then having enough of this bush racing tactic reacts to Jason. Many a young jockey in many countries have had senior jockeys lashing them on the back when they transgress, i have heard dozens of... read more

My Soul Mate Rounds Off Varsfontein’s Champions Day Treble
Rachel V was carded to ride .05 kgs overweight (her 1.5 female allowance was not applicable in this race) - this is approx 3 lengths over this distance - the horse lost my less than half a length - both her backers and owners can feel unlucky.
The consolation is that the information was known before the race.
I continue to be surprised by how many people ignore the effect of weight over these extended trips - another example on the day was the MDK horse Immediate Edge whom some were touting as a superstar and July winner. A basic weight calculation would have indicated to punters that IE could never beat Wild Intent who gave him 3 kgs (6 lengths) over the 2,000 meters in their previous run.
Now those that backed the horse for the July will probably lose their money because he will now need to just about win the Daily News to get into the July and off his current rating of 94 (probably closer to 101) - it will be a virtually impossible task.
I suppose there is some hope because MDK is his

Those sitting on these judicial hearings are independent legal practitioners appointed by the NHA, probably with some knowledge about horse racing.
These appointees could presumably differ from case to case, hence fines could possibly not always seem to be consequent (I am astounded at times by the difference in sentences handed down by magistrates for the same offence).
Don't know much about the inner workings of the NHA in legal matters, there's a lack of transparency, perhaps due to confidentiality aspects - public not invited to hearings, no live streaming of due process and so on.
How many people make the actual decision, if more than one, is a quorum required for example, or what.
Perhaps it's all stipulated in the constitution, but I'm kinda lazy today.

The NHA is legally obligated to report this case to the SAPS for further investigation now that it has concluded its own internal investigation. A crime of assault with the intent to do GBH has been committed. Furthermore, the deliberate reckless actions which endangered both the horse and jockey must be fully investigated by the
