Racist Comments: Colour Holder Guilty

Mrs Nieuwenhuizen has the right of appeal against the penalty imposed

National Horseracing AuthorityThe National Horseracing Authority confirms that an inquiry was held at its offices on Tuesday, 10 November 2015 into alleged racist comments made by colour holder Mrs H Nieuwenhuizen to a member of the public on the 16th of May 2015 at the Turffontein Racecourse.

Mrs Nieuwenhuizen was charged with a contravention of Rule 72.1.43, in that as a registered colour holder, Mrs Nieuwenhuizen contravened this Rule by making racist comments to a member of the public at the Turffontein Racecourse on 16 May 2015.

Mrs Nieuwenhuizen pleaded guilty to the charge.

The Inquiry Board found Mrs Nieuwenhuizen guilty and in determining a suitable penalty, the Board considered the evidence and mitigating factors presented by Mrs Nieuwenhuizen and ruled that the appropriate penalty be that she be fined the sum of R20 000, of which R15 000 is suspended for a period of one year, provided that Mrs Nieuwenhuizen is not found guilty of a similar contravention during this period.

Mrs Nieuwenhuizen has the right of appeal against the penalty imposed.
