NHA: Trainer PL Smith – Various Charges

Enquiry held on Friday 30 October

National Horseracing AuthorityThe National Horseracing Authority confirms that an Inquiry was held at its offices at Turffontein Racecourse on Friday, 30 October 2015.

Mr P L Smith was charged with a contravention of Rule 73.2.4 in that a specimen taken from the horse NEW MARKET, after it broke down shortly before the finish line in the 1st race run at the Flamingo Park Racecourse on 27 July 2015, was found to contain the prohibited substance Carprofen, a prohibited substance in terms of Rule 73.4.

Mr Smith pleaded guilty to the charge and was found guilty of the charge.

Mr Smith was further charged with a contravention of Rule 73.2.4 in that a specimen taken from the horse EVERCELL, after it participated in and won the 2nd race run at the Flamingo Park Racecourse on 27 July 2015, was found to contain the prohibited substance Carprofen, a prohibited substance in terms of Rule 73.4.

Mr Smith pleaded guilty to the charge and was found guilty of the charge.

National Horseracing AuthorityAfter considering all the facts relevant to this matter, the Board treated both charges as one and imposed a penalty of a fine of R30 000.

Furthermore, in terms of Rule 72.3.2 EVERCELL is disqualified from the 2nd race run at the Flamingo Park Racecourse on 27 July 2015 and the provisions of Rule 67.7.8 shall apply.

Mr Smith was further charged with a contravention of:

Rule 10.5.16.1:

In that he had on his premises where he trains the following prohibited substances: Carprofen, Flunixin (contained in Finadyne), Procaine (contained in Duplocillin), Prednisolone-21-hemisuccinate (contained in Solu-Delta-Cortef), Dexamethasone, 9-αFluoroprednisolone and Lidocaine. In respect of the said substances found on the premises where he trains, he was in breach of the unless requirements contained in Rule 10.5.16.

Mr Smith pleaded not guilty to the charge, but was found guilty of the charge.  The Board imposed a penalty of a fine of R1 000.

Rule 10.5.16.3:

In that he had on the premises where he trains the prohibited substance 17α-Hydroxyprogesterone Caproate and that in respect of the said substance found on the premises where he trains he was in breach of the unless requirements contained in rule 10.5.16.

Mr Smith pleaded not guilty to the charge, but was found guilty of the charge.  The Board imposed a penalty of a fine of R3 000.

Rule 10.5.16.5;

In that he had on the premises where he trains the forbidden substance Testosterone Cypionate and that in respect of the said substance found on the premises where he trains he was in breach of the unless requirements contained in rule 10.5.16.

Mr Smith pleaded not guilty to the charge, but was found guilty of the charge. The Board imposed a penalty of a fine of R7 500.

Rule 10.5.16:

In that he had on the premises where he trains two bottles, one containing the prohibited substance Duplocillin (containing Procaine Penicillin G) and the other bottle containing the prohibited substance Finadyne (containing Flunixin), and that neither bottle had a label on it containing the name of the horse to which the said substance is to be administered as required in the unless requirement contained in rule 10.5.16.

Mr Smith pleaded not guilty to the charge, but was found guilty of the charge. The Board imposed a penalty of a fine of R1 000.

Rule 10.5.14:

In that he did not accurately record or cause to be recorded in a treatment register any veterinary treatment to any horses under his care and nor did he have a treatment register on his premises or at all.

Mr Smith pleaded guilty to the charge and was found guilty of the charge. The Board imposed a penalty of a fine of R5 000.

Mr Smith has the right of appeal against the findings and penalties imposed relating to the matters dealt with in paragraph 8.1, 8.2, 8.3 and 8.4 above.

Mr Smith has the right of appeal against the penalty imposed in the matter dealt with in paragraph 8.5 above.
