An inquiry was held in Johannesburg on Wednesday, 9 September 2015 into Mr Binda’s conduct in the Boardroom before and after the running of Race 7 at the Vaal Racecourse on 25 August 2015.
Trainer Binda was charged with a contravention of Rule 72.1.25 in that he misbehaved and conducted himself in an improper manner before and immediately after the running of Race 7.
Mr Binda pleaded guilty to the charge.
The Inquiry Board found Mr Binda guilty.
In coming to a penalty, the Board considered all the factors presented by Mr Binda in mitigation including what had happened at the start with the loading of the horse LADY AL and in particular, after viewing the patrol film of the start, noted the disturbing sight of LADY AL being trapped under the stalls.
The Board also noted that Mr Binda has a clean record and that he tendered an apology on the 26th of August 2015. The Board imposed a fine of R10 000.00 of which R5000.00 is wholly suspended for a period of three years on condition that Mr Binda is not found guilty of a similar contravention during this period.
Mr Binda has the right of appeal against the penalty imposed.
