The National Horseracing Authority confirms that an Appeal against the finding and the penalty imposed by an Inquiry Board upon Jockey Xolane C Ndlovu was heard on 21 October 2020.
Background
At an Inquiry held on 23 July 2020, Jockey X C Ndlovu was charged with a contravention of Rule 62.2.1 in that, whilst riding ROSE A VELDT, he failed to ensure that his horse was given a full opportunity to win or obtain the best possible placing in the first race run at Fairview Racecourse on 6 July 2020 and imposed a penalty of a suspension from riding in races for a period of sixty (60) days.
The Appeal Board, after having heard the submissions put forward in this matter, both on behalf of the Appellant and on behalf of the Respondent, unanimously ruled:
- that Jockey Ndlovu had contravened Rule 62.2.1;
- that the penalty of a suspension imposed by the Inquiry Board be reduced from sixty (60) to thirty (30) days, and that the thirty (30) day period be wholly suspended for a period of twelve (12) months, on condition that Jockey Ndlovu is not found guilty of a contravention of the above Rule during that period;
- that in terms of Rule 85.5.8, the prescribed Appeal fee lodged by the Applicant, is forfeited.
