The National Horseracing Authority confirms that at an Inquiry finalized in Port Elizabeth on 28 November 2011, Trainer Justin Snaith was charged with a contravention of Rule 73.2.4 in that he was the trainer and the person responsible for the horse FRAGRANT AL who ran in and won the 6th race at Arlington Race Course on 11 March 2011, after which a plasma specimen taken from this horse disclosed upon analysis the presence of Phenylbutazone and Oxyphenbutazone which are prohibited substances in terms of the Rules of The National Horseracing Authority. There was no evidence that Trainer Snaith either administered or authorized the administration of these prohibited substances to the horse FRAGRANT AL.
Trainer Snaith pleaded not guilty but was found guilty of the charge. The Inquiry Board imposed a fine of R40 000.00.
Furthermore in terms of Rule 72.3.2 FRAGRANT AL is disqualified from this race and the stake monies are to be returned for re-distribution in terms of Rule 67.7.8.
Trainer Snaith has the right of appeal.
