The Gauteng Gambling Board (“the Board”) has turned down Phumelela’s application to amend its Totalisator and Race-Meeting Licences (“the Application”). Phumelela requested permission to withdraw the Application a year ago as it was prepared to continue to live with the condition. The Board refused and accordingly Phumelela did not submit further arguments supporting the Application.
Importantly, the Board did not grant the relief sought in a complaint by the Gauteng Off-Course Bookmakers’ Association (“GOBA”), although it did rule that it would investigate whether Phumelela has complied with its licence conditions or contravened the Gauteng Gambling Act, 4 of 1995 (“the Investigation”).
The far-reaching relief sought in GOBA’s complaint included the immediate suspension of Phumelela’s licences.
Equally importantly, the Board also did not make any decision which would adversely affect or delay Tellytrack’s ability to charge a licence fee reflecting the fair economic value of the Tellytrack service.
Furthermore, the interim directive made by the Board on 9 October 2014, which effectively directed Phumelela to ensure that Tellytrack is made available to bookmakers at the 2013 price plus inflation until the hearing, is no longer of any force or effect.
The Board deferred an application by GOBA for the imposition of additional conditions on Phumelela’s Totalisator and Race-Meeting Licences, pending the completion of the Investigation.
