Appeal – Jockey Andrew Fortune

The National Horseracing Authority confirms that an Appeal lodged by Jockey Andrew Fortune was heard in Johannesburg on Tuesday, 7 December 2010.

Background

At an Inquiry which was finalised on 10 September 2010, Jockey Fortune was charged with a contravention of Rule 62.2.3, in that he failed to ride his mount out to the end of the race thereby costing himself 3rd place, at the Turffontein Racecourse in Race 2 on 4 September 2010.

The Inquiry Board imposed a penalty of a suspension from riding in races for a period of one month and a thirty thousand rand fine of which ten thousand rand was wholly suspended for a period of one year, provided that this Rule has not been transgressed during that period.

Finding of the Appeal Board

After careful deliberation, the Appeal Board confirmed the month’s suspension but reduced the monetary penalty to twenty thousand rand, with no suspended portion. Jockey Fortune’s suspension took effect from 7 December 2010.

The Appeal Board ruled in its discretion that the appeal deposit fee be refunded.

Appeal  – Trainer J S Roux

The National Horseracing Authority confirms that an Appeal lodged by Trainer Mr J S Roux was heard in Johannesburg on Tuesday, 7 December 2010.

Background

At an Inquiry which was finalised on Friday, 10 September 2010, Trainer Roux was charged with a contravention of Rule 73.2.4 in that he was the person responsible for the horse TARA’S FLIGHT at the time when a specimen, taken from this horse after it had participated in and won the 9th Race at the Arlington Racecourse on 11 June 2010, disclosed upon analysis the presence of FLUNIXIN and FUROSEMIDE, which are prohibited substances in terms of the Rules of The National Horseracing Authority.

The Inquiry Board imposed a penalty of a warning off.

Furthermore, in terms of Rule 72.3.2 TARA’S FLIGHT was disqualified from the and the provisions of Rule 67.7.8 shall apply.

Finding of the Appeal Board

After careful deliberation, the Appeal Board confirmed the penalty of a warning off.

The Appeal Board ruled in its discretion that the appeal deposit fee be refunded.
